1. Acceptance of Terms

By accessing and using the Ember & Vine website (the "Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this Service.

2. Reservation Policy

All reservations made through our website are subject to availability and confirmation. A deposit or credit card guarantee may be required for certain bookings, especially for larger parties or special events. Cancellations or modifications to reservations must be made at least 24 hours in advance to avoid a cancellation fee, which may be equal to the cost of the main course per person for the reserved party.

Failure to arrive for your reservation within 15 minutes of the scheduled time without prior notification may result in the automatic cancellation of your booking and potential forfeiture of any deposit or activation of the cancellation fee.

3. Pricing and Menu

All prices listed on our menu and website are in Canadian Dollars (CAD) and are subject to applicable taxes. While we strive to ensure accurate pricing and menu availability, Ember & Vine reserves the right to change prices and menu items at any time without prior notice. Special offers and promotions are subject to their own specific terms and conditions.

4. Intellectual Property

The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Service are protected under applicable copyrights, trademarks, and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication by you of any such matters or any part of the Service is strictly prohibited.

5. Limitation of Liability

Ember & Vine, its directors, employees, partners, agents, suppliers, or affiliates, shall not be liable for any loss or damage, direct or indirect, incidental, special, consequential or punitive damages, including without limitation, economic loss, loss or damage to electronic media or data, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
